Terms of Service

These Terms of Service ("Terms") govern your access to and use of Akantio POS ("Service"), operated by Akantio ("we", "us", or "our"). By purchasing a license or creating an account, you agree to be bound by these Terms.

1. The Service

Akantio POS is a Point-of-Sale software that runs locally on your Windows device. It handles sales, and product management. Akantio POS requires an internet connection to activate and manage licenses, but can run in offline mode for a limited time.

2. Accounts

You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account.

You must be at least 18 years old and have legal authority to enter into contracts on behalf of your company (if applicable) to use the Service.

3. Licenses and Permitted Use

Upon purchase, we grant you a non-exclusive, non-transferable license to use the Akantio POS software on the number of activated devices permitted by your subscription plan.

• Each license may only be activated on devices within your organization.
• You may not sublicense, resell, or distribute the software.
• Reverse engineering, decompiling, or modifying the software is prohibited.
• Device limits are enforced as specified in your plan. Exceeding limits requires upgrading.

4. Free Trial

New accounts may be eligible for a 14-day free trial. No payment is required during the trial period. At the end of the trial, continued use requires purchase of a license. We reserve the right to modify or discontinue the trial offer at any time.

5. Payments and Billing

License fees are charged at the time of purchase. All prices are in Euros (EUR) and are exclusive of applicable taxes unless stated otherwise.

Payments are processed securely by Stripe. We do not store your full payment card details. By providing payment information, you authorize us to charge the applicable fees.

License renewals are not automatic unless explicitly stated. You will receive notification before a license expires.

6. Refunds

Due to the digital nature of software licenses, all purchases are generally final and non-refundable once a license key has been issued and activated. If you experience a technical issue preventing use of the software, please contact us at [email protected] within 7 days of purchase. Refund eligibility is assessed on a case-by-case basis.

7. Support

We provide email support at [email protected] during business hours (Mon - Fri, 10 am - 5 pm CET). We aim to respond within 1 business day. Support covers installation assistance, license activation issues, and software defects.

8. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of applicable regulations.
• Attempt to gain unauthorized access to the platform or other users' accounts.
• Interfere with the integrity or performance of the Service.
• Share account credentials with unauthorized third parties.
• Use automated means to access the Service in a manner that exceeds normal usage.

9. Intellectual Property

All rights, title, and interest in the Service, including all software, trademarks, and content, remain the exclusive property of Akantio. These Terms do not grant you any rights to our intellectual property except the limited license described in Section 3.

10. Termination

We may suspend or terminate your account at any time if you breach these Terms. You may terminate your account by contacting us; however, termination does not entitle you to a refund of unused license time.

Upon termination, your right to use the software ceases and any active device activations will be revoked.

11. Disclaimer of Warranties

The Service is provided "as is" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.

12. Limitation of Liability

To the maximum extent permitted by applicable law, Akantio shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service. Our total aggregate liability shall not exceed the amount you paid us in the twelve months preceding the claim.

13. Governing Law

These Terms are governed by the laws of the European Union and applicable member state legislation. Any disputes shall be resolved in the courts of competent jurisdiction.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of significant changes by email or by posting a notice in the customer portal. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
